UTV offers UTV@play (hereinafter “Offer”) is subject to the following Terms and Conditions (hereinafter “Terms”):
Please read these terms carefully before registering to use this service currently known as utv offers (utv@play). By proceeding with registration and use of utv offers utv@play, you agree to be legally bound by these terms. If you do not agree to these terms, please do not use utv offers utv@play.

TERM:

This Offer is organized by UTV, a company having its registered office at Parijaat House, 1076, Dr.E.Moses Road, Worli Naka, Mumbai-400018 and the Offer is valid during promotional offer period only as announced in the UTV channel from time to time.
This Offer is valid only for existing category of active Subscribers who fulfill the following criteria:

You must be above 18 years of age.
You must be a citizen of India
You must not have any criminal record nor be of an unsound mind

System plays portal jingle and welcome prompt; UTV offers UTV@play in Hindi, English, Marathi, Gujarti, Telugu & Malayalam

Call charges would be @ Rs. 11/min.

To increase his/her chances of winning the caller has to answer the questions by selecting the option from his phone keypad.

For every correct answer, caller will receive 10 points. The higher the score, the higher will be his/her chances of winning. Caller can play the contest multiple times.

If the caller opts not to make an offer he/she may do so by pressing 9 as directed in the system If you disconnect after playing, then the next time you call at the beginning of each call the current total score of the user will be played out.

This Offer is being made purely on a “best effort” basis and participation of eligible subscriber is voluntary.

TERMS & CONDITIONS:

The UTV, UTV@play contest is a limited period offer as announced in the promotional advertisements in the UTV channels from time to time for (Delhi, Harayana, UP West, UP East, Gujarat, Maharashtra, Andhra Pradesh, Kerala, Himachal Pradesh, Madhya Pradesh & Rajasthan viewers.
The contest will be open from (19th June 2008 at 00:00 hrs)
The contest is open for residents of India only.
Premium call rates shall apply to the caller on dialing 505-999505, no other means of participation will be accepted for the contest.
Dialing 505-999505 (pl. read terms) is the only route for participation. Responses sent by any other means will be summarily rejected
UTV will not be responsible in any manner whatsoever for failure of any backend technology of IVR application and resultant inability of a user to send in his entry or the loss of score arising there from and his/her inability to qualify for the prize draws because of such failure.
Details of Prizes & Winner Selection are as under:
Weekly winner – cash prize of Rs.1 lakh, Bumper prize winner (at the end of 10 weeks) – Rs.10 lakhs. Special cash prizes of Rs. 50,000/- for weekly winner from AP & Kerala Circles each over and above the afore-mentioned prizes. Winners will be selected based on highest score for the particular week Thu-Wed (mid-night). Weekly winners including special weekly prize winners will be in-eligible for subsequent weekly prizes but can continue to play for the Bumper prize. Bumper prize would be won by the user having the highest accumulative points at the end of 10th week. UNMV reserves the right to final decision on winners.
While UTV will make every effort to declare the results for prize draws within 7 days of the participation deadline for the respective prize draws, UTV will not be responsible for any delay in announcing winners of the respective prize draws arising out of reasons beyond its control in the normal course of business.
The winners will be eligible for the prizes only after they have received an intimation from UTV. Visuals and names of the prizes depicted in our promos / communication are only indicative of the product category of prizes and in way is an indication of the brand, model or any other product attribute of the prizes. The visuals etc do not have any association to the number of prizes what so ever.
Employees of UTV and its affiliates/subsidiaries, sponsors of the prizes, associated agencies, participating operators and their immediate family members and relatives are not eligible to participate in this contest.

Only the winners will be informed by UTV. The participant with maximum number of entries and list of winners may be displayed on (www.utvi.com) and / or /televised in UTV Movies/ Bindass Channel or intimated to the participants/winners in any manner as UTV deems fit.
The cash prize would be sent to the winner in form of a pay order via registered post. In case the same is returned with addressee not being present for receipt, wrong address, or any other reason Prizes must be collected within 30 days of declaration of results. Wherever possible, UTV may courier prizes to the winners with intimation to the winners and all prize dispatches will start only after 2 weeks of declaration of results of the draw. If the reader/winner does not claim the prize for any reason whatsoever within 30 days of declaration of results, he/she will automatically forfeit any claim to the prize.
The prize(s) shall not be transferable and no such request shall be entertained by UTV
UTV will not be responsible for any defects/inadequacy in the products given as prizes and the same would have to be addressed to the manufacturer directly. UTV would not be liable to replace/exchange the prizes at any stage of the offer.
UTV does not take any responsibility for any errors arising out of incorrect or incomplete contest entry.
The winner is solely responsible for any other expenses related to the acceptance and use of the offer.
Any levies, duties, TDS and taxes, wherever applicable, shall be borne by the winner/s.
If instructed by UTV, prize must be claimed in person on production of a identity proof / address proof / PAN card / Letter of Compliance with rules and regulations The documents required to be submitted along with the claim by the winner include the above (the document list is only inclusive and not exhaustive and can change as per the requirements of Law).
In case false/fake identification details are submitted, the concerned person/addressee/winner shall be disqualified immediately from the contest.
Any attempt by a Participant to deliberately damage any website or undermine the legitimate operation of the Scheme is a violation of Criminal and Civil Laws and should such an attempt be made, UTV reserves the right to seek damages from any such Participant to the fullest extent permitted by law.
UTV reserves the right to extend or to cancel, discontinue or terminate the said contest at any time or to accept or reject any or all entries at their absolute discretion without giving any prior notice and without assigning any reason whatsoever.
UTV shall not be responsible for any direct or indirect loss or damage suffered by the winner / participant while participating in the contest or availing the offer including but not limited to personal injury and damage to property, whether direct or consequential, foreseeable, due to some negligent act or omission or otherwise, whatsoever.
In the event of any winner choosing not to accept a prize(s) on or before the assigned date or forfeits any and/or all claims the prize(s), UTV shall have the absolute discretion to deal with such prize(s) as it deems fit.
Where a specified prize becomes unavailable, UTV in its absolute discretion reserves the right to substitute the said prize(s) with any other prize(s).
In the event of any winner choosing not to accept a prize(s) or forfeit any and/or all claims qua the prize(s), UTV shall have the absolute discretion deal with such prize(s).

Winners, if minor, will be disqualified.
The Scheme shall be governed by and construed in accordance with the laws of India. Any disputes, differences and, or, any other matters in relation to and arising out of the Scheme and, or, pertaining to the rules and regulations and, or, the Terms and Conditions shall be referred to arbitration under the Arbitration & Conciliation Act, 1996. The arbitral tribunal shall consist of a sole arbitrator to be appointed by UTV. The venue of arbitration shall be Mumbai.
All disputes shall be subject exclusively to Delhi jurisdiction only.
All entries will be treated as the property of UTV
All decisions by UTV regarding the selection of the winners shall be final and binding.
UTV in its absolute discretion may publicize, broadcast or otherwise disclose a contestant's name, character, likeness, statements or any recording of their voice in advertising or promotional activities concerning this contest, or generally. UTV may promote or advertise that a winner has won the contest.
UTV in its absolute discretion reserves the right at anytime, without giving any previous notice to the participants, add, alter, modify, change or vary all or any of these Terms & Conditions, wholly or in part.
By participating in the contest the participant agrees to abide with the aforesaid terms and conditions or any such terms and conditions as may be determined by UTV

The subscriber understands that Idea Cellular is in no way related to the organizers and administrators of the contest. Nor is it directly or indirectly involved in selection of winners.
